On 7/9/2020, the US Supreme Court ruled in McGirt v. Oklahoma that Congress did not properly and lawfully disestablish the Muscogee Creek Nation (MCN) when establishing the state of Oklahoma in 1907. As a result, the historical boundaries of the MCN were reaffirmed. Since the initial decision, additional tribes have also had their boundaries re-established. We will cover the underlying facts of McGirt, the case litigation history, the practical impact on public safety, and then what’s next.
